Chapter 1 General Provisions

■ 【Article 1 Purpose】

The purpose of establishing these terms of service is based on H99 PROPERTY SDN. BHD. (hereinafter referred to as "the Company"), operating the website http://www.h99property.com (hereinafter referred to as "H99" or "the Website"), where members must be individuals with full legal capacity or legally registered corporations or organizations. Upon joining as a member, users can begin using the services provided by H99. These terms of service are established to clarify and regulate the rights, obligations, and responsibilities between the Company and its members.

Article 2: Publication and Use of Service Terms

1.     The content of these Service Terms is announced on the H99 website. By becoming a member or visiting, browsing, and using this website, you are deemed to have read, understood, and agreed to the Service Terms. If you disagree, please immediately stop using this website.

2.     H99 may revise these Service Terms, Privacy Protection Policy, Disclaimer, and any current or future rules that are published and implemented. The revised or changed content will be announced on the H99 website. If there are no objections from members within seven days after the announcement, the revised terms, rules, policies, or statements will automatically take effect and apply to all services provided by H99, whether directly or indirectly through network-connected platforms such as mobile phones, emails, or phone calls.

Article 3: Nature of the Website

1.     H99 only provides a third-party platform service. H99 is not a party to the transaction agreement between users and members but serves as a third-party platform connecting users and members. Therefore, users should directly contact and conduct transactions with members regarding issues like renting or purchasing properties, rather than with the H99 website.

2.     H99 is not a party to the transaction. H99 will not intervene in any buying, selling, services, or other transactions between users and members. H99 does not assume any guarantee or responsibility for the services or other transaction items obtained by users.

3.   Although H99 uses commercially reasonable techniques to manage and pay attention when providing services, due to the nature of the internet, H99 cannot verify or judge the authenticity of the source or the data posted by members. Therefore, both parties in the transaction should conduct their own due diligence in advance. If any disputes or adverse outcomes arise due to one party violating the law, both parties shall bear all responsibility, and H99 shall not be held liable. Additionally, according to applicable laws, H99 may not be able to limit or exclude the above-mentioned liabilities. In such cases, H99 will assume responsibility within the scope of applicable laws. Claims should be made promptly after the event that causes the claim occurs. Claims delayed beyond the applicable complaint period without legitimate reason may be considered invalid. Only bona fide claims will be processed.

Matters not specified in these Terms of Service, Privacy Statement, Disclaimer, and various rules currently or subsequently issued and enforced by H99 will be handled in accordance with government regulations.

By agreeing to these Terms of Service and joining as a member, you may begin using the services provided by H99.

2. To become an H99 member, individuals must have full legal capacity or be legally registered corporations or organizations. If a minor under the age of eighteen (or under the legal age of majority in certain countries or regions where it is different from 18) engages in transactions on this website [rental/sales section or lease/purchase request section], it is required that their parents (or guardians) read, understand, and agree to all the terms of this service and any subsequent amendments before the minor can use or continue using the service. By using or continuing to use the service, it is presumed that the parents (or guardians) have read, understood, and agreed to accept all the terms and any subsequent amendments of this service agreement. H99 will not be responsible for any disputes that arise between a minor member and the other party of the transaction or any third party due to the use of the services on this website.
